 Art.1 – General Provisions

  1. By navigating in this area, the user accesses Triololive through the URL: triololive.com. Browsing the site and transmitting a purchase order on the site implies acceptance of the conditions and data protection policies adopted by the site itself and indicated therein.
  2. These General Conditions of Sale apply to the sale of products with exclusive reference to purchases made on the site in accordance with the provisions of Part III, Title III, Chapter I, Consumer Code (D. Lgs. n. 206/05 amended by D. Lgs. n. 21/14 and D. Lgs. 70/03) by:

  1. The user is required, before accessing the products provided by the site, to read these General Conditions of Sale which are generally and unequivocally accepted at the time of purchase.
  2. The user is invited to download and print a copy of the purchase form and these Terms and Conditions of Sale, the terms of which Triololive reserves the right to modify unilaterally and without notice.

Art. 2 Object 

  1. These General Terms and Conditions of Sale govern the offer, submission and acceptance of purchase orders for products on Triololive and do not govern, however, the provision of services or the sale of products by parties other than the seller who are present on the same site through links, banners or other hypertext links.

Art. 3 Conclusion of the Contract

  1. In order to conclude the purchase contract, it will be necessary to fill in the form in electronic format and send it following the relevant instructions.
  2. It contains a reference to the General Conditions of Sale, the images of each and its price, the means of payment that can be used, the mode of delivery of the products purchased and the related shipping and delivery costs, a reference to the conditions for exercising the right of withdrawal, how and when to return the products purchased.
  3. Before concluding the contract, you will be asked to confirm that you have read the General Conditions of Sale including the information on the right of withdrawal and the processing of personal data.
  4. The contract is concluded when the seller receives the form filled in by the user, after verifying the correctness of the data contained therein.
  5. The user will be obliged to pay the price from the moment in which the procedure of forwarding the order on line will be concluded. This will happen by clicking on the “conclude order” button at the end of the guided procedure.
  6. Concluding the contract, the seller takes charge of the order for its evasion (within working hours).

Art. 4 – Registered Users

  1. In completing the registration procedures, the user is obliged to follow the instructions on the site and to provide his personal data correctly and truthfully.
  2. Once registered, the user will receive an email to the email address provided by him.

Art. 5 – Availability of Products

  1. The availability of products refers to the actual availability at the time the user places the order.
  2. In the event of partial or total unavailability of the goods, the order will be rectified automatically with the elimination of the unavailable product and the user will be immediately informed by email.

Art. 7 – Payment methods and prices

  1. The price of the products will be as indicated on the site.
  2. The prices of the site are inclusive of VAT excluding shipping costs. Prices may change at any time. Any change will not affect orders for which confirmation has already been sent.
  3. Once selected the desired products, they will be added to the cart. It will be enough to follow the instructions for the purchase, inserting or verifying the required information in every step of the process. Order details can be modified before payment.
  4. Payment can be made by: Credit Card, Debit Card and Paypal.

Art. 8 – Delivery

  1. Triololive ships throughout Italy and abroad.
  2. The shipment is generally made within 3-5 working days from the receipt of the order.
  3. The shipping terms indicated on the site, while carefully evaluated, are not binding for Triololive, which can subsequently confirm or modify them, depending on its actual needs.
  4. The shipping time for an order containing items with different delivery times is equal to the longer shipping time of the items in the order. Any delays in delivery of less than 30 days do not give the customer the right to refuse delivery of products, nor to claim compensation or damages.
  5. The delivery is considered executed from the moment the product is delivered to the Customer.
  6. The delivery document issued by the carrier, dated and signed by the Customer upon delivery of the product, will constitute proof of transport and release of the goods.
  7. Moreover, it is advisable that upon delivery, the Customer checks the content, conformity and condition of the products, before signing the receipt.
  8. If the Buyer finds any anomalies, he must refuse the delivery of the products or put in writing his reserves, detailed and dated.
  9. In the event that the courier’s document is signed by the buyer without affixing any “reserve”, the same can not make any objection about the external characteristics of the goods delivered.
  10. In case of termination of the contract of sale, the amounts will be returned, including any shipping costs, within 7 days from the date of cancellation of the order.

Art. 9 Warranty and commercial conformity

  1. The seller is responsible for any defect of the products offered on the site, including the non-conformity of the ordered items, according to the Italian law.
  2. In case of non-conformity, the user who has entered into the contract as a consumer will be entitled to obtain the restoration of conformity of the products without charge, by repair or replacement, or to obtain an appropriate price reduction.

Art. 10 – Withdrawal

  1. In accordance with current regulations, the purchaser has the right to withdraw from the purchase in accordance with the provisions of the Consumer Code.
  2. Users who intend to exercise the right of withdrawal must notify Triololive at info@triololive.it, indicating the order number and personal data.
  3. The goods must be returned to: Azienda Agricola Triolo, via P. Mattarella snc – 91022 Castelvetrano (TP)
  4. The goods must be returned intact, in original packaging and complete in all its parts with attached tax documentation. Without prejudice to the right to verify compliance with the above, Triololive will refund the amount of the products subject to withdrawal within a maximum of 7 days.
  5. Triololive will make the refund using the same means of payment chosen by the purchaser at the time of purchase.

Art. 11- Personal data processing

  1. The buyer’s data are processed in accordance with the provisions of the legislation on the protection of personal data, as provided for in Article 13 EU Regulation 2016/679.

Art. 15 – Applicable law and competent court

  1. These general conditions of sale are governed by Italian law and interpreted in accordance with it, without prejudice to any other prevailing mandatory rule of the country of habitual residence of the purchaser.
  2. Any inherent and/or consequent disputes shall be resolved exclusively by the Italian jurisdictional authority. In particular, if the user is a consumer, any disputes will be resolved by the Court of the place of domicile or residence of the same under the applicable law.
